OAS - WORKING GROUP TO ELABORATE THE DRAFT AMERICAN DECLARATION ON THE RIGHTS OF INDIGENOUS PEOPLES
The Organization of American States is a regional agency within the meaning of Article 52 of the United Nations Charter.
Working Group to prepare the Draft American Declaration on the
Rights of Indigenous Peoples was approved by the Organization of
American States Commission on Human Rights; Inter-American Court of
Human Rights on August 27, 2004
FIAAH is a member representative for the U.SA to the Caribbean
Antilles Indigenous Peoples Caucus & the Diaspora, CAIPCD. CAIPCD
is one of the representative bodies for indigenous people’s to the OAS
for negotiations with the Working Group to prepare the draft
Declaration on the Rights of Indigenous Peoples.
The Declaration is to be presented to the permanent Council in the
first half of 2006 before the thirty –sixth regular session of the
General Assembly.
The
point of consensus for the fourth meeting are articles XIX-XXIV of the
American Draft Declaration. These articles dealt with traditional forms
of property and cultural survival. Right to land, territory and
resources, treaties agreements and constructive arrangements, cultural
identity, right to environmental protection, organizational and
political rights.
At these
meeting FIAAH recommendations was voted and approved by the caucus for
the inclusion of the words “Communities” and collective recognition
into the Article for Rights to Environmental protection into the
draft. Inclusion of these words will ensure indigenous Americans of
North America living within the United States jurisdiction as black
American communities will not be excluded from having avenues for being
recognized under this legislation for stopping environmental
exploitation with in their communities. Example: hazardous waste
dumping or building playgrounds around or above hazardous waste sites.
Today this is common practice in black American communities.
FIAAH
presented many recommendations for context in writing the legislation
(words) to be ratified in the upcoming meetings. FIAAH will be actively
working on bringing this declaration into American International law
thru the General Assembly for 2006.
